Contracting parties
This agreement (hereinafter referred to as “the Agreement”) is entered into between the user (hereinafter referred to as “the Customer”) and SkyttelPASS AS (hereinafter referred to as the “Company”) and regulates the Customer’s use of SkyttelPASS (hereinafter referred to as the “Tag”) and licence plate recognition when paying fees/costs incurred by use on roads and ferry connections. The agreement also regulates the Customer’s use of the Tag in other services that the Company offers, and which are associated with the Tag. Discounts and benefits applicable when using the Tag and license plate recognition can be found on the Company’s website www.skyttelpass.no.
1. Introductory terms and conditions
1.1 The SkyttelPASS agreement is valid from the day after the Customer has received confirmation of agreement. As soon as the Company has linked a tag to the Agreement, the Customer will receive notification by email. The Company may carry out a credit check before final approval. If a credit check is carried out, the Customer will be made aware of this.
1.2 The Agreement with the Company that has issued the Tag is considered the Customer’s main AutoPASS-agreement. If the Customer signs an additional agreement with a toll road company or ferry company (hereinafter referred to as “Operator”), such an agreement must be linked to the same Tag. Use of the Tag in an additional agreement presupposes a valid main agreement with the Company.
1.3 The Tag is used for electronic payment at toll road points, toll ring areas and on ferry connections, and in any other services that the Company may offer through the Customer’s use of the Tag. The Company has the right to charge the Customer for use of the Tag. 1.4 The Tag is issued by the Company for a tag fee paid by the Customer of NOK 200 per tag. If your customer relationship has been transferred to the Company from Svinesundsforbindelsen, the Company will refund any paid tag deposit upon the Customer sending their old tag to the Company once the agreement with Svinesundsforbindelsen has been terminated.
1.5 Rates and discounts for using the Tag at tolls points, toll ring areas and on ferry connections are set by Norwegian public authorities. Rate information is available at www.autopass.no and from the individual Operator. Information about discounts and benefits when using the Tag can also be found at www.skyttelpass.no
1.6 Upon entering the Agreement, the Customer consents to the collection, storage and processing of personal data about the Customer.
2. The customer’s obligations and rights
2.1 The obligation to pay toll road charges follows from the Regulation on payment of toll road charges, dated 28. November 2016, no. 1418, on the legal basis of the Road Act § 27. The Customer is the contracting party in this Agreement. The Customer is responsible for paying for all use of the Tag, and also for all toll road charges and ferry journeys accrued based on photos taken of the licence plate number when passing a toll point, toll ring area or ferry entrance.
2.2 The Customer is obliged to comply with the terms and conditions of use as they stand at all times and accepts these when entering into the Agreement.
2.3 The Tag must not be used in vehicles other than the vehicle registered to the Tag in the Agreement. The Customer is obliged to follow the instructions that apply for the correct installation and use of the Tag. Information is available at www.skyttelpass.no.
2.4 The Customer is responsible for ensuring that information provided in the Agreement is always correct. All changes, such as change of vehicle/sale of a vehicle or change of personal data must immediately be reported to the Company. This also applies to any additional agreement with a toll road company or ferry company (Operators) that the Customer may have. Information about local agreements offered by the individual Operators can be found on the Operators’ websites. Customers with foreign registered vehicles are themselves responsible for registering the vehicle with the correct environmental parameters in the Company’s central system upon creating the Agreement. The Customer can at all times check whether information in the Agreement is correct and make changes by visiting My Page on the Company’s website www.skyttelpass.no or by contacting the Company.
2.5 Neither the Tag nor the Agreement can be transferred to other persons or legal entities.
2.6 The Customer is responsible for paying for all use of the Tag, regardless of who uses the Tag. In the event of a lost or damaged Tag, a fee will be charged to issue a new Tag. In the event of theft, a police report is required before the Customer’s responsibility under the Agreement ceases.
2.7 If the Agreement is valid, the Customer pays with liberating effect to the Company for toll road charges and ferry journeys registered by the Tag that are made at an Operator’s toll point, toll ring area and ferry entrance. This does not apply to payment for toll road charges and ferry journeys made under local agreements offered by an Operator.
2.8 If the Tag has not been read when passing a toll road point, toll ring area or ferry entrance, the Customer is responsible for the accrued charge based on photographs taken of the vehicle licence plate as the vehicle passes a toll road point, toll ring area or ferry entrance. For vehicles without a valid Agreement, the Operator will send an invoice to the owner of the vehicle as registered in the Vehicle Register. The same applies if the Company in exceptional cases cannot make charges on behalf of the Operator. In such exceptional cases, the Customer will be treated as a full-price customer without prior notice.
2.9 The Customer is responsible for removing the Tag when selling or disposing of the vehicle. The Tag can then be registered to a new vehicle. If the Tag is not to be used in a new vehicle, the Customer must terminate the Agreement via My Page or notify the Company immediately. In the event of ownership change /disposal of a vehicle, the Customer is responsible for any accrued toll road and ferry charges or other fees associated with the use of the Tag or via photography of the licence plate number until the Customer has terminated the vehicle on their Agreement via My Page or via notification to the Company. By removing a vehicle on the Agreement via My Page, the Customer avoids toll road charges and ferry journeys being charged to the Agreement after the sale date/termination. Upon contacting customer service via email, some processing time must be expected.
2.10 The Customer is entitled to the at any given time applicable discount and any applicable exemption on toll road charges and ferry journeys as long as the Tag has been read and the Agreement is valid. The Customer’s right to discounts associated with other services that the Company offers while the Customer is using the Tag may follow from special terms and conditions for use of such services. The right to a discount and any exemption ceases when the Agreement is blocked or terminated.
3. The company’s obligations and rights
3.1 The Company is the payment intermediary between the Customer and the Operators in the AutoPASS Cooperation and the EasyGo Joint Venture.
3.2 The Company provides the Customer with discounts in accordance with the rates that are at any given time applicable so long as road toll and ferry journeys are registered, and the Agreement is valid. The right to a discount and any exemption ceases when the Agreement is blocked or terminated in accordance with section 8.
3.3 Any claims against the Company are limited to the Customer’s reimbursement of wrongfully imposed and paid fees due to errors by the Company.
3.4 The Company can block the Agreement, see sections 4.4 and 4.5.
3.5 Without prior notice to the Customer, the Company can make changes to the Agreement and corrections that are necessary to administer the contractual relationship, including, for example, correcting charges and information about the Customer.
3.6 Significant changes in the Agreement that apply to the Customer’s obligation to pay toll road charges can occur due to decisions made by the Norwegian authorities or other extraordinary circumstances beyond the Company’s control. Such changes will be announced no later than four weeks prior to the changes taking effect. Changes in rates and prices for toll road charges are announced in accordance with regulations issued by the Ministry of Transport and the Norwegian Public Roads Administration.
- The Company can transfer the Customer’s agreement to another company. In such instance, notice will be given to the Customer 14 days prior to the Company transferring the Agreement.
4. Payment and settlement
4.1 By entering into an agreement with the Company, the Customer agrees that the Company can carry out a credit check if necessary. The Company can demand financial security when entering into agreement or in any future breach of the Agreement by the Customer (Issuer Regulations §19).
4.2 Upon creating the Agreement, the Customer chooses their preferred invoice and payment method. For updated information on invoicing and payment methods, see www.skyttelpass.no. In line with Issuer Regulations § 19, the Company can impose fees or additional costs related to various payment methods. See www.skyttelpass.no for an overview of fees and rates.
4.3 The Company offers the Customer several electronic invoicing options. If the Customer chooses to receive their invoice by post (paper invoice), an environmental invoice fee will be added.
4.4 In the event of non-payment, incorrect address or any other cause that results in the Company not receiving payment form the Customer, the Company can immediately block the Agreement without notice. The right to discounts will thus cease, and unpaid invoices will be sent for debt collection.
4.5 The Customer can see their invoices on My Page. An unreceived invoice or debt collection notice does not release the Customer from payment responsibility.
5. Privacy
5.1 The Company will process the Customer’s personal data for the purpose of collecting payment from the Customer for toll road and ferry charges, to produce anonymous statistics, as a basis for providing information to the Customer, and for the implementation and administration of the Agreement with the Customer. The processing of personal data will take place in accordance with the privacy legislation that is at the time applicable.
5.2 Registration of personal data in connection with the Customer’s toll road and ferry charges takes place by tag reading or by automatic photography of the vehicle’s licence plate number.
5.3 The Company provides an electronic customer page called My Page which provides the Customer with an overview of the Customer’s agreement, toll road and ferry charges, invoices, and payments. The purpose of My Page is to provide the Customer with a practical opportunity to manage their customer relationship.
5.4 Information about the Customer and customer transactions can be provided by the Company to Operators of the AutoPASS Cooperation and the EasyGo Joint Venture in Norway and abroad, in addition to ferry companies with electronic ticketing.
5.5 If the Agreement is transferred from the Company to another company, the personal data necessary to implement the Agreement can be provided to the new company.
5.6 The Customer has the right to access their personal data that the Company processes and to demand correction of incorrect or incomplete personal data. The Customer can also request that personal data be disclosed or deleted to the extent that disclosure or deletion is not in conflict with legal regulations. 6. Communication and complaints
6.1 Inquiries from the Customer about the Tag and this Agreement must be directed to the Company, see section 1.2. Other inquiries regarding full-price invoices for toll road charges, ferry journeys, local exemptions or additional agreements must be directed to the Operator.
6.2 Unless otherwise determined, notifications from the Company to the Customer about the Agreement will be sent either by letter or email to the address stated by the Customer in the Agreement or be provided via the Company’s website. Messages from the Company can also be given in invoices, via SMS to the mobile number stated by the Customer in the Agreement, in payment reminders and in debt collection notices.
6.3 Complaints about toll road and ferry charges etc. must be submitted to the Company no later than three weeks after the Customer received or should have received knowledge of the matter that justifies the complaint. The Customer may lodge a complaint to the Norwegian Public Roads Administration regarding the Company’s payment claim and other decisions concerning the Agreement. Legal disputes related to the Agreement shall, as per the Dispute Act, be decided by the court district in which the Company has its head office.
7. Termination of agreement
7.1 The Customer has the right to terminate the Agreement with the Company at all times.
7.2 Terminations must be notified to the Company immediately, either via My Page or by contacting the Company’s customer support. By removing vehicles from the Agreement via My Page, the Customer prevents the Agreement from being charged after termination of the Agreement or sale date of the vehicle. In the case of inquiries made by email to our customer support centre, some processing time must be expected. Upon confirmation that the request for termination has been received (or termination has been completed by the Customer via My Page), the Tag can be disposed of as electrical waste or kept for future use.
7.3 The Company can terminate the Agreement with 14 days’ notice if: Circumstances change based on a decision made by Norwegian authorities, if the Tag for light cars (under 3500 kg) has been inactive for more than two years, and if the Agreement does not provide a financial benefit or is not obligatory for the Customer.
7.4 The Company can terminate the Agreement immediately if the Customer substantially breaches obligations towards the Agreement, and in the event of the Customer’s bankruptcy or death. Failure to pay will always be considered a substantial breach.
8. Local agreements
8.1 If the Customer is entitled to local exemptions or exemptions according to the tariff guidelines,
the Customer must contact the individual Operator for information about this.

8.2 The individual Operator is responsible for the administration and collection of payment for toll road and ferry charges covered by local agreements.
